Terms and conditions

  1. Software License Terms

    These terms apply to paid proprietary software supplied by:

    Armin Šupuk
    Bankstrasse 2
    6280 Hochdorf
    Switzerland
    armin@supuk.ch

    They supplement Creem’s Buyer Terms. Creem acts as merchant of record and contractual reseller for purchases made through its checkout. If these product-specific terms conflict with Creem’s Buyer Terms on a matter governed by those terms, Creem’s Buyer Terms prevail. Mandatory consumer rights always prevail over both.

    Ordering and payment

    The software, license type, activation limit, price, currency, and other material offer details are shown before purchase. By completing the order, you ask Creem to process the purchase and ask that the digital product be delivered electronically after payment is confirmed.

    Creem collects the payment, issues the invoice, and calculates, collects, and remits applicable VAT, sales tax, or other indirect tax. The total shown in Creem’s checkout is the amount payable to Creem. A submitted order is complete only when Creem confirms payment.

    Electronic delivery and license recovery

    After payment is verified, the generated license details are sent to the email address used at checkout and are also displayed through a browser receipt. The receipt link is temporary and normally remains available for ten minutes. Save the key securely and do not share it. The email is sent through Lettermint; acceptance by Lettermint means acceptance for delivery and does not guarantee when or whether a particular inbox will receive it.

    If the receipt is closed or the email is unavailable, use the license-recovery form, select Creem, and enter the checkout email address. An exact Creem order ID may also locate the stored purchase. Recovery sends all licenses matching that Creem identity to the email address already stored with those purchases; the submitted lookup cannot redirect delivery to another address. The page does not reveal whether an email address matched. A payment gateway whose stored identity has no email instead issues a temporary browser receipt. Recovery never creates another license.

    For delivery problems, first check the checkout mailbox and spam folder. Then contact armin@supuk.ch and include the Creem order ID if available. Do not send card details or a license key by ordinary email.

    License grant

    For each completed purchase, you receive a personal, non-exclusive, non-transferable, non-sublicensable license to install and use the purchased software for lawful purposes, subject to these terms and the activation limit presented with the offer.

    The current VPN Leak Guard offer permits up to three active device activations at the same time. You may deactivate a device through the software’s license-management screen and activate another device, subject to technical and anti-abuse controls.

    The software and all intellectual-property rights in it remain owned by Armin Šupuk or the applicable licensors. The purchase transfers a right to use the software, not ownership of the software or its source code.

    VPN Leak Guard lifetime license

    VPN Leak Guard is sold under a one-time lifetime, also described as perpetual, license. “Lifetime” and “perpetual” describe the duration of the license to use the purchased version; they do not promise:

    • perpetual updates, upgrades, new features, or compatibility work;
    • perpetual technical support;
    • permanent availability of checkout, activation, validation, download, or other hosted services; or
    • compatibility with future Android versions, devices, firmware, VPN applications, or network configurations.

    Updates or support may be provided at no charge, for a fee, or discontinued. A later major version may require a separate license unless its offer states otherwise.

    Permitted use and restrictions

    You may use the software only for your own personal use and within the stated activation limit. Unless mandatory law expressly permits it, you must not:

    • share, sell, assign, rent, sublicense, publish, or redistribute the software or license key;
    • copy the software except for ordinary installation or a lawful personal backup;
    • bypass, disable, evade, or interfere with license activation, validation, device limits, or security controls;
    • reverse engineer, decompile, disassemble, modify, or create derivative works from the software;
    • use the software or related services unlawfully, fraudulently, or in a way that harms the software, services, operator, or another person; or
    • remove or alter copyright, attribution, or proprietary notices.

    Interoperability, security research, and other rights that cannot lawfully be excluded remain unaffected.

    License status and termination

    The license remains valid for its stated duration while you comply with these terms. The license key may be disabled, and access to related license services may be suspended, after:

    • a refund or payment reversal;
    • a chargeback;
    • fraud, misuse, or an unauthorised transaction; or
    • a material breach of these terms.

    Where a material breach can reasonably be cured, an opportunity to cure may be provided before termination unless immediate action is reasonably necessary to protect the software, services, users, or legal rights. On termination, you must stop using and delete the software and license key. Terms that by their nature should continue, including restrictions, intellectual-property provisions, disclaimers, liability limits, and dispute provisions, survive termination.

    Support

    Product, license-delivery, and refund requests should be sent to armin@supuk.ch. Support is provided on a reasonable-efforts basis. No response time, resolution time, maintenance period, or service level is guaranteed unless expressly agreed in writing.

    Questions about checkout, invoices, payment methods, or Creem’s customer portal may also be directed to Creem through the contact methods in its Buyer Terms.

    Refunds and consumer remedies

    Refund requests are assessed case by case. Send the request and Creem order number to armin@supuk.ch. If a refund is approved or legally required, Creem processes it as merchant of record. The associated license may then be disabled.

    Nothing in these terms limits a mandatory remedy for defective or non-conforming digital content, including repair, replacement, price reduction, cancellation, damages, or another remedy available under applicable consumer law.

    For an EU consumer purchasing digital content delivered immediately, Creem’s checkout and Buyer Terms govern the express request for immediate delivery and the acknowledgement that the statutory 14-day withdrawal right is lost once delivery begins, where the law permits. If that rule does not apply, any mandatory withdrawal right remains available.

    Software operation and warranties

    VPN Leak Guard assesses and mitigates specific technical conditions described in the software and its documentation. Results can depend on Android, device firmware, hardware, VPN software, permissions, and network state. The software is not a promise that every possible traffic leak, vulnerability, misconfiguration, or compromise will be detected or prevented.

    To the maximum extent permitted by law, the software and related services are provided as available, without guarantees that they will be uninterrupted, error-free, compatible with every environment, or suitable for a particular purpose. Any description made part of the offer and all warranties or remedies that cannot legally be excluded remain binding.

    Liability

    Nothing in these terms excludes or limits liability for intent, gross negligence, death or personal injury caused by negligence, fraudulent misrepresentation, breach of a mandatory product or consumer obligation, or any other liability that cannot lawfully be excluded or limited.

    For other claims, to the maximum extent permitted by law:

    • liability is limited to direct, reasonably foreseeable loss caused by a breach of these terms;
    • there is no liability for indirect or consequential loss, lost profits, lost business, lost opportunity, or loss or corruption of data; and
    • aggregate liability arising from the purchased license is limited to the amount paid for that license.

    You remain responsible for appropriate device security, backups, network configuration, and decisions made using the software’s results.

    Changes to these terms

    The version made available before your purchase governs that purchase. These terms may be updated for future purchases or where a change is reasonably required by law, security needs, or service operation. A later version will not retroactively reduce mandatory rights or the stated duration of a completed license purchase.

    Governing law and venue

    These product-specific terms are governed by Swiss law, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods.

    Subject to any mandatory consumer forum or other non-waivable jurisdiction, the courts at the operator’s domicile in the Canton of Lucerne, Switzerland, have exclusive jurisdiction. Creem’s Buyer Terms separately govern the relationship between the buyer and Creem.

  2. Affiliate Program Terms

    These terms govern participation in the affiliate program offered by Armin Šupuk and hosted through Creem.

    If you like my apps, recommend them to others and earn a 30% commission on qualifying purchases. The program covers all my apps sold through Creem, and referrals are tracked for 180 days. Join the affiliate program to get your personal referral link and track referrals and payouts through Creem.

    Scope and participation

    The program covers all eligible products sold through Creem, including all Armin Šupuk apps currently sold there. It does not cover purchases through another seller or channel. Creem hosts enrollment and supplies each accepted participant with a personal referral link and account tools.

    By joining or participating, you accept these terms and the Creem terms and platform rules presented during enrollment or account use. Creem’s rules govern the platform functions it operates, including account eligibility, attribution records, and payout administration. These terms govern your affiliate relationship with Armin Šupuk.

    Qualifying purchases, commissions, and attribution

    The commission is 30% for a qualifying purchase. A qualifying purchase is a genuine, successfully paid purchase of an eligible product by another person that Creem attributes to your personal referral link within the 180-day referral period and that is not fraudulent, self-referred, cancelled, refunded, charged back, or otherwise reversed.

    The referral period begins when Creem records a prospective buyer’s use of your personal referral link and ends 180 days later. Creem’s tracking records and applicable platform rules determine attribution, including where more than one referral or another tracking condition may apply. A visit or recommendation does not earn a commission unless Creem records a qualifying purchase.

    Refunds and reversals

    No commission is payable on a refunded, charged-back, cancelled, fraudulent, or otherwise reversed purchase. If Creem has already recorded or paid a commission for such a purchase, the commission may be cancelled, deducted from a future balance or payout, or recovered through the process Creem makes available.

    Lawful promotion and disclosure

    Promotions must be lawful, accurate, and not misleading. You must not send unlawful or unsolicited messages, make false product or earnings claims, impersonate Armin Šupuk or Creem, present yourself as an employee or official representative, manipulate referral tracking, use cookie stuffing or similar forced attribution, or promote through fraud, deception, harassment, or other abusive conduct.

    You must clearly and conspicuously disclose your affiliate relationship wherever required by law or platform policy. The disclosure must appear close enough to the referral link or recommendation for the audience to understand that you may earn a commission. You are responsible for following the advertising, consumer-protection, privacy, electronic-communications, and platform rules that apply to your promotion.

    Creem tracking and payouts

    Creem hosts the affiliate account, issues the personal referral link, tracks referrals and qualifying purchases, applies the 180-day attribution period, reports commissions, and manages payouts. You are responsible for using the correct link and keeping the account, tax, identity, and payout information requested by Creem accurate.

    Payout timing, thresholds, methods, currencies, verification, and any platform deductions are administered through Creem under its applicable terms and account information. Questions or corrections concerning tracking or payouts must use the records and procedures available through Creem.

    Suspension, termination, and changes

    You may stop participating at any time by discontinuing promotion and using the account options Creem provides. Armin Šupuk may suspend or terminate participation for a breach of these terms, suspected fraud or manipulation, unlawful or misleading promotion, harm to a product, customer, provider, or reputation, or a Creem eligibility or compliance requirement. Immediate suspension or termination may occur when reasonably necessary to prevent harm or abuse.

    After termination, you must stop using the personal referral link and stop presenting yourself as a participant. Valid commissions recorded before termination remain subject to refunds, reversals, these terms, and Creem’s platform rules. A commission connected to fraud, manipulation, unlawful conduct, or another breach is not payable and may be reversed.

    The program, eligible products, commission rate, attribution period, or these terms may change or end prospectively. Changes will not retroactively reduce a valid commission already recorded for a qualifying purchase, except where a refund, reversal, fraud, tracking correction, or legal requirement applies.

    Responsibility and governing law

    Participation does not guarantee traffic, referrals, purchases, commissions, or any level of earnings. Nothing in these terms excludes liability or rights that cannot lawfully be excluded.

    These affiliate terms are governed by Swiss law, excluding its conflict-of-law rules. Subject to any mandatory forum or other non-waivable jurisdiction, the courts at the operator’s domicile in the Canton of Lucerne, Switzerland, have exclusive jurisdiction.
